Dear Privacy Notice Reader,

 

We guess you are there as you would like to understand better how and why we use your information. Indeed, you have noticed you are part of MyData-Trust’s (“MD-T”, the Data Controller) distribution list to receive regular updates and communications about developments in data protection field, and you probably want to know more about the way we handle your information.

That’s great: you are at the perfect place for this!

This Privacy Notice indeed aims to provide you with all the needed information to understand the processing of your data in this context. If, however, there are still grey area after you have read it, do not hesitate to contact our DPO at [email protected] that will be very pleased to clarify anything further, or liaise with the right MDT-er(s) to do so!

Now, here are all the details you’ve been waiting for!

 

Why are we using your information?

We are using your email address to send you (approximately once per month) our newsletter or invite you to our data protection related events.

Our newsletter focusses on the news on Data Protection field. It can also contain information on MD-T events, articles, links to our previous webinars, all of this always being related to data protection.

You can also, independently of our newsletter, receive invitations for our MD-T data protection events.

 

How have you landed in MD-T distribution list?

Depending on your specific case, you can be in this distribution list and receive MD-T communications because:

  • You have subscribed to our newsletter on MD-T website.
  • You agreed to receive our communications when we proposed it to you.
  • You participated to a previous MD-T event, LinkedIn Live, you are working at an actual or former MD-T client, you are in contact with our commercial team, or you have an account on MD-T platform(s) and have not objected to our communications.

 

 

What is the reason that allows MD-T to send me such data protection communications?

Under data protection legislation, the use of a person’s personal data must rely on a legal basis. In other words, data protection law set out some grounds and each personal data processing activity must be supported by one of them. This can be the person’ consent, or a legal obligation to process data for example.

Depending on the reason why you are in our distribution list, the legal basis is different:

  • If you subscribed to our newsletter on our website, or agreed to receive our communications when we proposed it to you, the use of your information to send you our data protection communications is based on your consent.

 

  • If you participated to a previous MD-T event, LinkedIn Live, you are working at an actual or former MD-T client, you are in contact with our commercial team or you have an account on MD-T platform(s), the processing is based on MD-T’s legitimate interest to propose you communications in the field of data protection that may be interesting for you, as you are or have already been in contact with MD-T services.

 

How long will you remain in MD-T distribution List?

You will remain in our distribution list until you withdraw your authorization or you object to receive our data protection communications (depending on the legal basis supporting the processing).

In both cases, if you do not want any more to receive our data protection related communications, please select one of those communication you have previously received, go at the bottom of the page and click on the “unsubscribe” link.  We will then stop to send you our data protection news.

Please note however that we may retain your email address in an internal blacklist, to ensure we are not adding you back in our distribution list by mistake later on.

 

Are we sharing your information with someone else?

MD-T is not selling or sharing information with someone else for their own use. We may however store your information internally in our folders (Sharepoint) and we use Brevo to send our communications. It means such IT providers (Microsoft and Brevo) are technically processing your information, without however accessing it.

 

What are your rights in relation to your data?

You can exercise the following rights:

  • Access: You have the right to obtain confirmation as to whether we process your data or not and, where that is the case, all necessary information to render the processing transparent.
  • Rectification: You have the right to ask us to rectify any inaccurate or incomplete data.
  • Erasure: You have the right to request the deletion of your personal data.
  • Restriction: You can ask restriction of the processing of your data, meaning your information will only be stored not otherwise used, unless you give your authorization for this.
  • Portability: You have the right to request the receipt and/or the transfer to another organization, in a machine-readable form, of your personal data.
  • Right to withdraw consent: When you have given your consent for the processing of your data, you can withdraw it at any time.
  • Object to processing: You have the right to object to the processing of your data.

 

How can you exercise your rights?

If you would like to exercise one or more of your data protection rights, please contact MD-T Data Protection Officer at [email protected]. Please note however that those rights are not always applicable, as they may be subject to legal exceptions or conditions of application that will be assessed in the course of your request.

Also, note that if you want to withdraw your consent to receive our data protection communications or object to it, this is easier for you to use the “unsubscribe” button available in each communication we send you, rather than contacting the DPO.

You also have the right to lodge a complaint with your local Data Protection Authority in the Member State of the European Union of your habitual residence, place of work or place of the alleged infringement if you consider that your personal data is not processed in accordance with data protection laws.
