Why is it so important to raise your staff GDPR awareness?

From 2018, after 4 years of negotiations, the European Data Protection Regulation (“GDPR”) unifies 28 different laws (one per Member State). The objective of the GDPR is to establish a single European regulation, adapted to the evolution of technologies.
The aim is to facilitate the transfer of personal data while guaranteeing their protection by:

  • Reinforcing the rights of individuals and
  • Empowering data processors

It has become clear that a compliance approach to this new regulation must be adopted, including awareness-raising and specific training for all staff involved in personal data processing operations. Employees and companies, should see the GDPR as an opportunity and not as a constraint. It is a comprehensive set of rules where law, technology and governance constitute a unique and inseparable tool.

Article 39(b) of the GDPR

One of the responsibilities of the Data Protection Officer (DPO) is to monitor compliance with the GDPR, including:

  • the assignment of responsibilities
  • raising awareness and training of staff involved in processing operations

With regard to Article 5(2) of the GDPR, the controller is accountable for demonstrating that it complies with all the principles relating to the processing of personal data.

It is necessary for companies to inform and train their staff but also to implement internal procedures to demonstrate compliance with data protection rules. Accountability essentially consists of documenting and maintaining what will allow, at any time, demonstrable the respect of the obligations that arise from the Regulations.
