Almost after a year of the green light by the Government, today the Parliament passed the first tranche of the Australian and Other Legislation amendment Bill 2024 (‘POLA’). Some of the provisions of the new Bill will enter into force as soon as it is formally sign into Law (Royal Assent).
The new bill supposes an innovation regarding the former framework, with the inclusion of provisions regarding:
Automated decisions affect the rights or interests of the individual → Update of privacy policies enhancing transparency and information over these technologies.

→ However, not all the amendments initially proposed have been included and a second phase of reforms is expected for 2025 (‘Tranche 2’) which has raise concern by industry professionals. For instance, the end of the small business exemption and the employee records exemption, data breach notification in 72 hours, extension of individuals’ rights, obligation to perform privacy impact assessments, notion of controller and processor, records retention and destruction, among others.
